This Acceptable Use Policy (this “Policy”) describes prohibited uses of the digital customer loyalty program and related services (the “Service”) offered by Hopeful Horizon Legacy LLC (doing business as “Hopeful Horizon”) and the website located at https://hhlhomes.com (the “Site”). This Policy supplements and is incorporated into Hopeful Horizon’s Subscription Agreement (available at https://hhlhomes.com/subscription-agreement) (the “Subscription Agreement”) and the Terms of Use (available at https://hhlhomes.com/terms-of-use) (the “Terms of Use”). To the extent of any conflict among these documents, the Subscription Agreement and Terms of Use will control unless a provision in this Policy expressly states it shall prevail.

By using the Service or accessing the Site, you agree to comply with this Policy. If you violate this Policy, Hopeful Horizon may suspend or terminate your access to the Service or Site. Hopeful Horizon’s rights to suspend or terminate access apply even if the violation was unintentional or occurred without your authorization where Hopeful Horizon reasonably believes suspension or termination is necessary to comply with law or to protect the rights, safety, privacy, security or property of Hopeful Horizon, its customers, or third parties.

1. Prohibited Conduct — Overview

You may not use the Service or Site for any unlawful, harmful, abusive, fraudulent, deceptive, or otherwise objectionable purpose. The rules below provide non-exhaustive examples of prohibited uses. Violations may result in suspension or termination of access, disclosure of information to law enforcement, and any other remedies available under law or contract.

2. Intellectual Property

You may not use the Service or Site in any way that infringes, dilutes, misappropriates, or otherwise violates the intellectual property or proprietary rights of Hopeful Horizon or any third party. This includes, without limitation, unauthorized reproduction, distribution, public display, creation of derivative works, or removal/alteration of copyright or trademark notices.

3. Harmful Software and Content

You may not transmit, store, display, distribute or otherwise make available any content or code that could damage, interfere with, surreptitiously intercept or expropriate any system, program or data. Examples include viruses, worms, bots, Trojan horses, ransomware, keystroke loggers, logic bombs, scripting exploits, or any other malicious code or software. You may not use the Service to facilitate creation, distribution or propagation of such harmful content.

4. No Framing, Scraping or Unauthorized Indexing

You may not frame, mirror or embed the Site (or any part of it) without Hopeful Horizon’s prior written consent. You may not use robots, spiders, scrapers, crawlers, screen-scrapers, data-mining tools, or other automated or manual methods to access, retrieve, index, copy, aggregate, reproduce, reproduce navigational structure, or otherwise gather Site content without Hopeful Horizon’s prior written consent. Public search engines are permitted to index the Site for publicly-available searchable indices only; Hopeful Horizon reserves the right to revoke such permission.

5. Unsolicited Messages and Email Abuse

You may not use the Service or Site to send unsolicited bulk email, text messages, or other communications (“spam”), nor to send messages that are excessive, harassing, abusive, or designed to annoy recipients. You must honor opt-out requests. You may not alter, obscure, or forge message headers, or engage in spoofing, phishing, or other identity-masquerading techniques.

6. System Security and Unauthorized Access

You may not use the Service or Site to compromise the security or integrity of any system, network, device or software. Prohibited actions include, without limitation:

Attempting to probe, scan, penetrate, breach, or circumvent authentication or security measures;

Gaining unauthorized access to any account, system, device, data, or network;

Monitoring or intercepting data, traffic, or communications without authorization;

Conducting distributed denial of service (DDoS), flooding, crashing, or other attacks;

Reverse-engineering, decompiling, disassembling, or modifying software or services except where expressly permitted by law; or

Using another person’s account, credentials or identity without authorization.

7. Privacy Violations and Confidential Information

You may not use the Service or Site to collect, publish, transmit, store, or otherwise make available personal, private or confidential information of third parties without lawful authorization (including account names, payment information, government ID numbers, or health information), or otherwise violate privacy or confidentiality obligations. Do not upload information you do not have a right to share.

8. Compliance with Laws and Export Controls

You may not use the Service or Site for any unlawful purpose or in violation of any applicable laws, rules or regulations, including data protection, privacy, consumer protection, export control or trade sanctions laws. You may not export, re-export or otherwise transfer any content or services in violation of any export control or sanctions laws.

9. No High-Risk Use

The Service is not designed or certified for use in high-risk environments where failure could lead to loss of life, serious bodily injury, or significant physical or environmental damage (for example, control of aircraft, air traffic control, nuclear facilities, life-support systems, or weapons systems). You may not deploy the Service for such uses.

10. Content that Promotes Illegal Activity or Harm

You may not use the Service or Site to publish, facilitate or promote unlawful activity, fraud, human trafficking, exploitation, terrorism, violent extremism, or materially illegal behavior. Content that meaningfully facilitates violent or criminal activity is prohibited.

11. Financial Abuse and Deceptive Conduct

You may not use the Service or Site to perpetrate financial fraud, misrepresentation, unauthorized billing, pyramid schemes, or other deceptive commercial practices. You must not provide false or misleading information in connection with use of the Service.

12. Responsibility for End Users

You are responsible for any violations of this Policy by persons who use the Service or Site under your account or with your permission. You are responsible for ensuring that people you authorize to use your account comply with this Policy. Assisting, facilitating or encouraging others to violate this Policy is a violation.

13. Monitoring and Enforcement

Hopeful Horizon reserves the right, but does not assume an obligation, to monitor compliance with this Policy, investigate suspected violations, and take any remedial actions it deems appropriate. These actions may include disabling content, suspending or terminating accounts, restricting access to the Service or Site, issuing warnings, and cooperating with law enforcement or regulators. Hopeful Horizon may disclose account and other information as required by law or to protect the safety, rights or property of Hopeful Horizon, its customers, or others.

14. Reporting Violations

If you become aware of any activity that violates this Policy, you must promptly notify Hopeful Horizon at:

15. Consequences and Remedies

Violation of this Policy may result in suspension, termination, legal action, and claims for damages. Hopeful Horizon may seek injunctive relief, recovery of costs and fees, and any other remedies available under applicable law or contract.

16. Changes to this Policy

Hopeful Horizon may modify this Policy at any time by posting a revised version on the Site. Your continued use of the Service or Site after a revised Policy is posted constitutes your acceptance of the revised Policy.
