Hopeful Horizon Legacy — Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the website located at https://hhlhomes.com (the “Site”), and any related websites or services made available by Hopeful Horizon Legacy LLC (doing business as “Hopeful Horizon”) (“Hopeful Horizon,” “we,” “us,” or “our”). By accessing or using the Site or any Content on the Site you agree to be legally bound by these Terms. If you do not accept these Terms, do not use the Site.

You represent that you are lawfully able to enter into contracts (for example, you are not a minor). If you agree to these Terms on behalf of an entity, you represent that you have authority to bind that entity and you agree that “you” includes both you personally and that entity. You and Hopeful Horizon are referred to collectively as the “Parties” and individually as a “Party.”

1. Subscription Agreement

These Terms do not govern use of any subscription, loyalty, or other paid service offered by Hopeful Horizon (the “Service”). If you access or use a Service, you will be subject to Hopeful Horizon’s Subscription Agreement (available at https://hhlhomes.com/subscription-agreement) or any separate written contract you enter with Hopeful Horizon.

2. Hopeful Horizon Content

The Site contains content including text, images, video, audio, applications, data, and other material (“Content”) owned or licensed by Hopeful Horizon (“Hopeful Horizon Content”). The Site and the Hopeful Horizon Content are protected by copyright, trademark, trade secret and other laws; Hopeful Horizon owns and retains all rights in them. Hopeful Horizon grants you a limited, revocable, non-sublicensable license to access, display, and perform the Hopeful Horizon Content (excluding any source code) solely for your personal, non-commercial use and solely as necessary to access and use the Site. Except as expressly permitted in these Terms or on the Site, you may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use Hopeful Horizon Content.

You may not remove, alter, or circumvent any copyright, trademark, or other proprietary notices or technological protection measures on the Site or its Content.

3. Trademarks

Trademarks, logos and service marks displayed on the Site are the property of Hopeful Horizon or third parties. You may not use any marks without Hopeful Horizon’s prior written consent or the consent of the applicable third party.

4. Third-Party Services

The Site may contain links to or integrations with third-party websites, applications, advertising, content, or other services (“Third-Party Services”). When you use a Third-Party Service, you are interacting with that third party and subject to its terms and policies. Hopeful Horizon does not control Third-Party Services, is not responsible for their content or practices, and inclusion of a link or integration does not imply endorsement.

6. Acceptable Use

7. Compliance with Laws

You represent and warrant that your access to and use of the Site will comply with all applicable laws, rules and regulations. Without limiting the foregoing, you agree to comply with anti-corruption laws (such as the U.S. Foreign Corrupt Practices Act), export controls, economic sanctions and other trade restrictions. You represent that you are not a person or entity subject to U.S. sanctions or otherwise prohibited from receiving services under applicable law.

8. Global Availability

Hopeful Horizon operates the Site from locations in the State of New Jersey, United States. If you access the Site from other locations you are responsible for ensuring that your use complies with local laws. Hopeful Horizon makes no representation that its services are available, appropriate or lawful outside the United States.

9. Indemnity

You agree to defend, indemnify and hold harmless Hopeful Horizon, its affiliates and their officers, directors, employees and agents from and against any claims, liabilities, losses, damages, costs and expenses (including reasonable attorneys’ fees) arising from or related to (a) your violation of these Terms; (b) your use of the Site; (c) your breach of applicable law; or (d) any content you post, upload or otherwise transmit to or through the Site.

10. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. HOPEFUL HORIZON DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. HOPEFUL HORIZON DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) IN NO EVENT SHALL HOPEFUL HORIZON, ITS AFFILIATES OR ITS OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THE SITE; AND (B) HOPEFUL HORIZON’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED TWO HUNDRED U.S. DOLLARS (US $200).

12. Responsibility for End Users

You are responsible for actions taken by anyone who accesses or uses the Site under your account or with your permission. Assisting or facilitating another person’s violation of these Terms is also a violation.

13. Termination and Monitoring

13.1. Hopeful Horizon may suspend or terminate your access to the Site if you breach these Terms or if Hopeful Horizon reasonably believes suspension or termination is necessary to comply with applicable law or to protect the rights, safety, privacy or property of Hopeful Horizon or third parties.
13.2. Hopeful Horizon may monitor use of the Site and investigate any suspected violations. Hopeful Horizon reserves the right to remove or refuse to post any content that it determines, in its sole discretion, violates these Terms or is otherwise objectionable. Hopeful Horizon may disclose information about users to law enforcement or other third parties where required by law or where Hopeful Horizon has a good-faith belief that such disclosure is necessary.

14. Electronic Communications

By using the Site or communicating with Hopeful Horizon electronically, you consent to receive communications electronically (for example by email or postings on the Site). Electronic communications satisfy any legal requirement that such communications be in writing.

15. Modifications

Hopeful Horizon may modify these Terms at any time by posting a revised version on the Site. Your continued use of the Site after the revised Terms are posted constitutes acceptance of those changes.

16. Governing Law and Venue

These Terms and any dispute arising out of or related to these Terms or the Site shall be governed by the laws of the State of Wyoming without regard to conflict of law principles. Any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state or federal courts located in State of Wyoming, USA, and you consent to personal jurisdiction and venue in those courts.

17. Miscellaneous

These Terms constitute the entire agreement between you and Hopeful Horizon regarding the Site and supersede all prior understandings and agreements. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect. No waiver by Hopeful Horizon of any right or remedy under these Terms will be deemed a waiver of any other right or remedy.
